Is non refundable legal?
Most retail stores allow you to return things you buy within a reasonable time for a full refund, credit, or an exchange. When a store clearly displays a limited or no-refund policy, however, refunds and exchanges are not required by law.
With the exception of a few scenarios, such as nonrefundable retainers and real estate security deposits, non-refundable deposits are valid so long as they are explicitly stated within the contract and reasonable under the circ*mstances that existed at the time the contract was signed.
You have the right to get your deposit back if the seller: Does not provide what was agreed. Cannot supply the product or deliver the service you ordered.
In many real estate transactions, the seller requires the buyer to pay earnest money in the form of a nonrefundable deposit. Indeed, this procedure is often the best way for a buyer to communicate to the seller that he or she really means business.
In California, it's illegal for landlords to require non-refundable deposits. All deposits are deemed to be the tenant's property, and a landlord must refund them either in full or in part once the tenant moves out.
This concept is often utilized as a form of liquidated damages, providing a predetermined amount to the landlord in case the tenant backs out of the deal.
The most common non-refundable deposit that we see is the requirement that a tenant pay last month's rent in advance. Unlike a standard security deposit, the payment of the last month's rent will not be given back to the tenant, but rather used to pay rent on the last month of the rental term.
The 14-day cancellation period starts the day the goods are in the physical possession of the consumer (or when the last item in the order is in the consumers possession in the case of multiple goods). Weekends and public holidays are included in the 14 days.
Consumer law may help you
A business can only keep the payments you've made in advance or ask you to pay a cancellation charge if it's fair to do so. A charge is not fair just because it's included in the contract you signed.

Are deposits legally binding?

Is Earnest Money Refundable? Earnest money isn't always refundable. The good news for buyers is in most situations, as long as a buyer acts in good faith, earnest money is refundable. As long as any contract agreements are not broken or decision deadlines are met, buyers usually get their earnest money back.
Whether you can get your deposit back will usually depend on the terms and conditions in your agreement. However, the general rule is the landlord or agent could keep your holding deposit if you decide not to rent the property later on.
Security deposit limits
Starting July 1, 2024, California's new Assembly Bill 12 (AB 12) will limit security deposits to one month's rent. This law applies to both furnished units and unfurnished units.
In a definitive sense, a retainer is a fee that is paid in advance in order to hold services (ie. a wedding or event date). While a deposit may also reserve a date, it is returned when the services have been completed. A retainer is by default non-refundable and is not returned.

If the other contracting party views the conduct of the other party in terminating a 'non-cancellable' agreement or an agreement that does provide for termination as a repudiation of the contract, this is considered a breach of contract.
Cancellation charges are per passenger. If a confirmed ticket is cancelled within 48 hrs and up to 12 hours before the scheduled departure of the train, cancellation charges shall be 25% of the fare subject to the minimum flat rate mentioned in the above clause.
A No Refund Policy is a term used by businesses to indicate that they will not provide money back to customers once a purchase has been made, regardless of the reason. This policy is often found regarding software downloads, event tickets, or other non-tangible items that cannot be returned.
There's no set format for writing or displaying a No Return, No Refund Policy. You can either have a separate Return and Refund Policy that confirms that all sales are final, or you can insert a clause prominently into another legal notice such as your Terms and Conditions agreement.
