Why do billionaires not pay taxes?
Currently billionaires effectively pay far less personal tax than other taxpayers of more modest means because they can park wealth in shell companies sheltering them from income tax, the group said in its 2024 Global Tax Evasion Report.
Currently, wealthy households can finance extravagant levels of consumption without even paying capital gains taxes on the accruing wealth by following a “buy, borrow, die” strategy, in which they finance current spending with loans and use their wealth as collateral.
That is possible because of the “billionaires' loophole”: under current law, increases in wealth (or “capital gains”) are counted as taxable income only when they are “realized” (i.e., when the assets are sold).
The idea is to purchase investments that appreciate in value, borrow against those assets, and use them as collateral for loans, then pass on those assets to heirs tax-free. These loans are offered by banks and brokerage firms and allow borrowers to use their investments as collateral to secure loans.
The newly released report covers Tax Year 2021 (for tax forms filed in 2022). The newest data reveals that the top 1 percent of earners, defined as those with incomes over $682,577, paid nearly 46 percent of all income taxes – marking the highest level in the available data.
Taxing the rich would pay incredible dividends in ending poverty and injustice. Calculations from Oxfam found that a progressive wealth tax on US multi-millionaires and billionaires could generate $664 billion dollars every year to help lift people out of poverty.
A wealth tax has all the existing bad features of the current income tax — complex, expensive to administer, costly to comply with, subject to manipulation and avoidance by those with the most resources and badly distorting of economic activity and capital formation.
Depreciation is one way the wealthy save on taxes. So, what exactly is it? “For federal income tax purposes, depreciation is a deduction that allows you to recover the cost or other basis of certain property,” tax expert Kelly Phillips Erb wrote in a post for Forbes.

High-Income Taxpayers Paid the Majority of Federal Income Taxes. In 2020, the bottom half of taxpayers earned 10.2 percent of total AGI and paid 2.3 percent of all federal individual income taxes. The top 1 percent earned 22.2 percent of total AGI and paid 42.3 percent of all federal income taxes.
Why do the rich borrow money?
To provide a bridge loan or secure liquidity: Borrowing can mitigate the need to sell assets with high return potential. Borrowing can also help avoid realizing taxable capital gains and transaction costs, while still providing liquidity to fund business ventures, or increase investments.
The key features of good debt are that it is used to acquire income-producing assets and has a reasonable cost structure compared to the expected returns. If this is the case, that is how debt leads to greater wealth creation.
Rich people use debt to multiply returns on their capital through low interest loans and expanding their control of assets. With a big enough credit line their capital and assets are just securing loans to be used in investing and business.
Because of a tax code feature known as “stepped-up basis,” unrealized gain on an asset is never subject to income tax if the asset is not sold during the owner's lifetime. As a result, much of the income of the wealthiest families in the country never appears on their income tax returns.
In 2020, the latest year with available data, the top 1 percent of income earners earned 22 percent of all income and paid 42 percent of all federal income taxes – more than the bottom 90 percent combined (37 percent).
